As most of you know the CDC has continued to prevent the serving of writs of possession for non-payment evictions all across the county; including Hillsborough County, Pinellas County, Pasco County, and Hernando County. Despite the fact that the national eviction moratorium was lifted back in September of 2020, the CDC continued its own moratorium exclusively for non-payment evictions indicating that if a proper declaration was filed the landlord could not remove the resident by means of writ of possession. That said, coupled with continued push back from landlords and the difficult to obtain rental assistance this has put some property managers into a tough position and as such has caused some property owners to get creative in order to remove their delinquent residents. One landlord we spoke to is amending their current signed evictions to be changed to a holdover eviction rather than non-payment and due to the fact that holdover is not protected under the current CDC guidelines they should be able to remove their residents once the judge signs the new orders. Either way you slice it you should still file an eviction for any reason despite the halting of non-payments. In doing so you show the residents that you are serious and could potentially come to an arrangement outside of court. Even if they don’t agree to an arrangement this begins the process and puts the landlord ahead of the game once this ban is ultimately lifted.
